We ask that you read this Privacy Notice carefully as it contains important information about who we are, how and why we collect, store, use and share personal information, your rights in relation to your personal information and how to contact us and/or supervisory authorities in the event you have a complaint.
Who we are:
Triumph Motorcycles Limited and Triumph Designs Limited (“we / us / our”) collects, uses and is responsible for certain personal information about you. When we collect and process this personal data, it is regulated under the General Data Protection Regulation, which applies across the European Union (including in the United Kingdom) and we are responsible as ‘controller’ of that personal information for the purposes of those laws. We are The Company committed to meeting its data protection obligations by being transparent about how we collect and use your personal data.
What information do we collect?
In the course of our internal business and commercial activities, we collect a range of information from and about you. This includes:
- your name, address and contact details, including email address and telephone number;
- details of your qualifications, skills, experience and employment history;
- information about your current level of remuneration, including benefit entitlements;
- whether or not you have a disability, which we need to enable us consider whether we need to make reasonable adjustments during the recruitment process; and
- information about your eligibility to work in the UK.
We will collect this information in a variety of ways. For example, data might be contained in application forms or CVs, obtained from your right to work documents, such as your passport or other identity documents, or collected through interviews or other forms of assessment.
We will also collect personal data about you from third parties, such as references supplied by former employers and information from employment background check providers. We will seek information from third parties only once a job offer has been made to you and will inform you that we are doing so prior to contacting them.
Information collected from other sources:
We also obtain personal data from other sources as follows:
- name, address, email and telephone contact details for you from Recruitment Agencies;
- bank details for the purposes of paying you as an employee;
- references from former employer(s);
- details of previous taxable income from HMRC (where you are successful in securing employment with us); and
- information from employment background check providers, following an offer of employment.
Why do we process your personal data?
We need to process data to assess your suitability for employment roles to which you have applied, prior to entering into an employment contract with you. We may also need to process your data to enter into an employment contract with you should you be successful in securing employment with us.
We will process special categories of data, such as information about ethnic origin, sexual orientation or religion or belief, to monitor recruitment statistics. We will also collect information about whether or not applicants are disabled in order to make reasonable adjustments for applicants who have a disability.
For some roles, we are obliged to seek information about criminal convictions and offences (including alleged offences). If your application is unsuccessful, we may keep your personal data on file in case there are future employment opportunities for which you may be suited. Your personal data will also be put forward in consideration of other job applications that you make to us (you will be able to review and edit the details before submission).
Reasons we can collect and use your personal information:
We rely upon Article 6 (f) of the GDPR (Legitimate Interest) as the lawful basis on which we collect your name, address, electronic, telephone and postal contact and all other personal details (including personal data acquired from third party background checks), which are not special categories of personal data under GDPR. Our legitimate interests are that we, acting responsibly and in its commercial interest seeks to manage an effective recruitment process; with the ability to contact applicants, confirm suitability and make an offer of employment. We rely upon this Legitimate Interest where it is required to collect and process your personal data for the purposes of defending legal claim(s) against us.
We rely upon Article 9 2(b) of the GDPR (processing is necessary for the purposes of carrying out our obligations and exercising specific rights of ours in the field of employment law) as the lawful basis on which we collect (including from third parties) and use your personal information relating to ethnic origin, health/disability, sexual orientation, religion, your right to work in the UK, trade union activity and information regarding criminal convictions and offences (including alleged offences).
We rely upon on Article 6 (a) and Article 9 (a) as the lawful basis on which it processes your personal data (including special category personal data) for the purposes of contacting you with future suitable employment opportunities if you are unsuccessful during the current recruitment process.
Who we share your personal information with:
We routinely share your name, address, electronic, telephone and postal contact details with a third party whom will process your personal data (including special category personal data) for recruitment purposes. The third party is Reach ATS, part of Instinctive Technologies Limited.
Where you successfully take up employment with us, we will share your personal details with the HMRC and the Department of Work and Pensions for the purposes of PAYE and National Insurance payments.
We will share your information with a third party for the purposes of conducting background checks if you are offered employment with us.
We will share personal information with law enforcement or other authorities if required by applicable law.
We will not share your personal information with any other third party.
Keeping your personal information secure:
We have appropriate security measures in place to prevent personal data from being accidentally lost, or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.
We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.
We will not transfer your data outside the European Economic Area.
For how long do we keep your data?
If your application for employment is unsuccessful, we will hold your data on file for 2 years after the end of the relevant recruitment process. If you agree to allow us to keep your personal data on file, we will hold your data on file for a further 1 year for consideration for future employment opportunities. At the end of that period (or once you withdraw your consent), your data will be destroyed.
If your application for employment is successful, personal data gathered during the recruitment process will be transferred to your HR file and retained during your employment. The periods for which your data will be held will be provided to you in a new privacy notice.
Under the General Data Protection Regulation you have a number of important rights free of charge. In summary, those include rights to:
- fair processing of information and transparency over how we use your use personal information;
- access to your personal information and to certain other supplementary information that this Privacy Notice is already designed to address;
- require us to correct any mistakes in your information which it holds;
- require the erasure of personal information concerning you in certain situations;
- receive the personal information concerning you which you have provided to us in a structured, commonly used and machine-readable format and have the right to transmit those data to a third party in certain situations;
- object at any time to processing of personal information concerning you for direct marketing;
- object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you;
- object in certain other situations to our continued processing of your personal information; and
- otherwise restrict our processing of your personal information in certain circumstances.

Changes to this privacy notice:
This privacy notice was published on 07 May 2018 and last updated on 07 May 2018.
We may change this privacy notice from time to time, when we do this information will be updated on the Reach ATS.
What if you do not provide personal data?
You are under no statutory or contractual obligation to provide your personal data to us during the recruitment process. However, if you do not provide the information, we may not be able to process your application.
Recruitment processes are not based solely on automated decision-making.
